for booking and participating in vetklinfo seminars
1.1 These Terms and Conditions apply to contracts for seminars and related services provided by vetklinfo, owned by Dr Stefan Lindner, Kirschallee 1, 04416 Markkleeberg (hereinafter “vetklinfo”).
1.2 These Terms and Conditions apply to online seminars and, where expressly offered, in-person events. They apply to consumers within the meaning of section 13 of the German Civil Code (BGB) and businesses within the meaning of section 14 BGB. Mandatory statutory consumer protection provisions remain unaffected.
1.3 “Customer” means the person or company that makes the booking and enters into a contract with vetklinfo. “Participants” are the people who attend the seminar booked. If a company books for employees or other people, it must ensure that those participants comply with the provisions of these Terms and Conditions that apply to them.
1.4 The Customer’s terms and conditions apply only if vetklinfo has expressly agreed to them.
2.1 The seminars displayed in the online shop do not constitute a binding offer. The Customer selects a seminar, adds it to the shopping cart, provides the information required during checkout and chooses an available payment method.
2.2 Before submitting an order, the Customer may review and correct the information entered. By clicking the order button clearly marked as creating a payment obligation, the Customer makes a binding offer to enter into a contract.
2.3 An automated acknowledgement initially confirms only receipt of the order, unless it expressly also confirms acceptance. The contract is concluded when vetklinfo expressly confirms the booking by email or activates the booked service, in particular access to the associated Moodle course, whichever occurs first.
2.4 Confirmation of the contract and the information required for consumers are provided electronically, in particular by email. The Customer must provide a valid email address and ensure that messages from vetklinfo can be received.
2.5 Places may be limited. Before a contract is concluded, vetklinfo may reject an order, in particular if the seminar is fully booked or the eligibility requirements are not met.
3.1 Offers expressly marked as student rates require suitable proof of current student status. The proof must be uploaded during checkout. Unnecessary information may be redacted provided student status and validity remain clearly identifiable.
3.2 A booking at the student rate is confirmed only after the proof has been verified successfully. If the proof is insufficient or the Customer is not eligible for the student rate, vetklinfo may request further evidence, reject the booking or, with the Customer’s consent, offer a booking at the regular rate. Any amounts received without a contractual basis will be refunded.
3.3 Any additional eligibility requirements arising from legal, professional or subject-matter requirements are stated in the relevant seminar description. Vetklinfo may request suitable proof.
4.1 The final prices displayed in the online shop at the time of the order apply. The total shown at checkout is decisive. VAT is stated in accordance with the applicable statutory provisions.
4.2 The payment methods shown at checkout are available. For online payment methods, payment is due during the payment process. For payment by invoice or a comparable method, the due date stated on the invoice applies; unless otherwise stated, the payment term is 14 days from the invoice date.
4.3 Vetklinfo may defer access to the seminar until payment has been received in full and, for discounted rates, until the required proof has been verified successfully.
4.4 If the Customer is in default of payment, the statutory provisions apply. Vetklinfo may suspend access to services that have not been paid for in full, to the extent permitted by law and taking account of the Customer’s statutory rights.
4.5 Vouchers, discounts and special terms may be combined only if the relevant offer expressly provides for this.
5.1 Vetklinfo uses the Moodle learning platform to organise and deliver online seminars. After a booking is completed, the participant’s existing Moodle account is used or, if necessary, a new account is created and enrolled in the course booked.
5.2 Moodle is used to provide seminar information and materials, access to the live event, any learning activities and tests, and—if the requirements are met—certificates of attendance or other certificates.
5.3 The live event is held using a video-conferencing solution embedded in or linked from Moodle. The specific technical solution may be changed provided this does not materially impair participation as agreed in the contract.
5.4 Participants must provide, at their own expense, an internet-enabled device, a sufficiently stable internet connection, a current supported web browser and working audio output. A microphone and camera may also be required if active participation by voice or video is expected.
5.5 Vetklinfo does not guarantee the availability of the participant’s internet connection or devices. Technical disruptions arising solely from the participant’s equipment or connection generally do not entitle the participant to a repeat session or refund, unless vetklinfo is responsible for the disruption.
5.6 Maintenance and temporary technical faults may affect access to Moodle or the video-conferencing solution. If a significant disruption for which vetklinfo is responsible occurs, vetklinfo will take reasonable steps to restore service and, where necessary, offer a reasonable replacement service or alternative date. Statutory rights remain unaffected.
6.1 The content, date, duration, format and other details of the service are set out in the relevant seminar description in the online shop and the associated information in Moodle.
6.2 Vetklinfo may change speakers, the programme or individual content for a valid reason, in particular illness or unavailability, new scientific findings, or changes in legal or regulatory requirements, provided the overall character and essential benefit of the seminar are preserved.
6.3 Seminar materials, in particular PDF presentations, may be made available for download. Continued or unlimited access to Moodle or seminar materials is provided only if expressly promised. The access period stated in the seminar description or in Moodle applies.
6.4 If a seminar includes a final test, the pass requirements stated in the relevant course apply. Unless otherwise specified, a certificate linked to the test requires a score of at least 75% of the available points. A certificate is issued only if the stated requirements are met.
6.5 Any professional recognition, continuing education credit or other accreditation stated for a seminar applies only to the scope expressly described and the status communicated when the offer was made. Decisions by external recognition bodies are outside vetklinfo’s control.
6.6 Vetklinfo is required to record a live event only if this is expressly stated in the seminar description. Without such a statement, there is no entitlement to a recording or its later availability.
7.1 Moodle and live-event login credentials are personal and must not be shared with third parties. The Customer or participant must take reasonable steps to protect them from unauthorised access.
7.2 Participants must not misuse the technical infrastructure, circumvent security measures or take any action that interferes with the operation of Moodle, the video-conferencing solution or other systems.
7.3 Audio, video or screen recording of a seminar, and recording chat content or contributions by other participants, is prohibited without the prior express consent of vetklinfo and, where applicable, the people concerned.
7.4 Vetklinfo may exclude participants from further participation in cases of serious disruption, unlawful content, insulting or discriminatory conduct, unauthorised advertising, spam or comparable breaches of duty. Where reasonable in the circumstances, the participant will first be asked to stop. Further statutory rights remain unaffected.
8.1 For good cause, in particular a speaker’s illness or unavailability, force majeure, official measures, significant technical disruptions or other unforeseeable circumstances, vetklinfo may appoint a replacement speaker, reschedule or cancel the event.
8.2 If an event is rescheduled, vetklinfo will inform the affected participants without undue delay and offer them a place on the replacement date. If attending on that date is unreasonable for the Customer, the Customer may withdraw from the contract with respect to the affected seminar service; any fees already paid for that service will be refunded.
8.3 If a seminar is cancelled and no equivalent replacement service is agreed, vetklinfo will refund any participation fees already paid for that seminar.
8.4 Any further claims, in particular for travel, accommodation or loss of earnings, are governed by the statutory provisions and the liability clause in section 11.
9.1 Consumers generally have a statutory right of withdrawal for distance contracts. The withdrawal period is generally 14 days from the conclusion of the contract. Further details are provided in the separate withdrawal notice made available during checkout and sent to the consumer on a durable medium.
9.2 If a consumer expressly asks vetklinfo to begin providing a service before the withdrawal period expires, the statutory rules on compensation for value apply in the event of withdrawal. The right of withdrawal for a service performed in full, or for digital content not supplied on a tangible medium that is made available early, expires only if the statutory conditions are met. Consent or acknowledgement to that effect is not replaced merely by agreeing to these Terms and Conditions.
9.3 Statutory exceptions to the right of withdrawal and other mandatory consumer rights remain unaffected.
10.1 Once any statutory withdrawal period has expired, there is no general contractual right to cancel free of charge unless the relevant seminar description or an individual agreement provides otherwise.
10.2 Merely failing to attend a seminar does not release the Customer from the obligation to pay. Statutory rights to terminate, withdraw, reduce payment or claim damages remain unaffected; any expenses saved or other income that must be credited by law will be taken into account.
10.3 Either party may still terminate the contract for good cause. Unless the law requires a stricter form, notices of withdrawal, rescission or termination may be sent in text form, in particular by email to info@vetklinfo.com.
11.1 Vetklinfo has unlimited liability for intent and gross negligence, culpable injury to life, body or health, under the German Product Liability Act, and to the extent of any expressly assumed guarantee.
11.2 In the event of a slightly negligent breach of a material contractual obligation, vetklinfo is liable only for the foreseeable loss typical for the contract at the time it was concluded. Material contractual obligations are those whose fulfilment is essential to proper performance of the contract and on whose fulfilment the Customer may ordinarily rely.
11.3 Otherwise, liability for damage caused by slight negligence is excluded to the extent permitted by law. The above liability provisions apply accordingly to vetklinfo’s legal representatives, employees, speakers and other agents.
11.4 Seminar content is prepared to the best of our knowledge and based on the professional, scientific and regulatory information available at the time of the seminar. Legal, regulatory, medical, veterinary and scientific conditions may change. Vetklinfo is required to update seminars already delivered or materials already provided only if this has been expressly agreed.
11.5 Seminars and materials provide general professional information and do not replace individual legal, medical or veterinary advice, or regulatory advice for a specific case. Vetklinfo does not warrant that authorities, courts, licensing bodies or other third parties will adopt any particular professional or legal assessment.
11.6 Statutory warranty, defect and other rights relating to digital products remain unaffected.
12.1 Seminar materials, presentations, graphics, videos, texts, tests and other content may be protected by copyright or other rights. Unless stated otherwise, participants receive a non-exclusive, non-transferable right to use the materials provided for their own participation, learning and professional development.
12.2 Unless permitted by law, content may not be published, shared with third parties, reproduced for distribution, redistributed for payment or free of charge, made publicly available or modified without the prior consent of the relevant rights holder.
12.3 Copyright notices, trademarks, logos, watermarks and other rights notices must not be removed or obscured.
13.1 Information about the processing of personal data in connection with the website, online shop, Moodle, payment processing and seminar participation is set out in the current vetklinfo Privacy Policy at www.vetklinfo.com/privacy.
13.2 If additional technical services are used to deliver a seminar, the privacy information required by law will be supplemented accordingly.
14.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the country in which they habitually reside.
14.2 The language of the contract is German.
14.3 If the Customer is a merchant, a legal entity under public law or a special fund under public law, Leipzig is the exclusive place of jurisdiction for disputes arising from the contractual relationship. Otherwise, the statutory places of jurisdiction apply.
14.4 Changes to or additions to individual agreements may be documented in text form unless the law requires a stricter form. Individual agreements take precedence over these Terms and Conditions.
14.5 If any provision of these Terms and Conditions is or becomes wholly or partly invalid, the validity of the remaining provisions is unaffected. The statutory provisions replace the invalid provision.
14.6 Statutory information obligations concerning consumer dispute resolution remain unaffected.
